Refund & Returns Policy

Thank you for choosing Benny Performance.

This Refund & Returns Policy applies to purchases made through our online store and is intended to explain your rights regarding returns, cancellations, exchanges, defects and refunds.

Nothing in this policy limits or excludes any mandatory consumer rights that cannot legally be excluded under Austrian or applicable European law.

1. Statutory Right of Withdrawal

For consumer purchases concluded by means of distance communication, such as through our online store, consumers generally have a statutory right of withdrawal of 14 days, without having to provide a reason.

The withdrawal period generally begins on the day on which the consumer, or a third party designated by the consumer, takes physical possession of the goods.

However, statutory exceptions apply.

2. Custom-Made and Personalized Products

Under § 18(1)(3) of the Austrian Distance and Outward Transactions Act (FAGG), the statutory right of withdrawal does not apply to goods that are manufactured according to the customer's specifications or are clearly tailored to the customer's personal requirements.

This may apply to products that are individually manufactured, modified, upholstered, configured or otherwise customized specifically according to the customer's individual requirements.

Examples may include individually manufactured or modified steering wheels and other vehicle components where the customer's individual specifications materially determine the final product.

However, the exception only applies where the legal requirements for a custom-made product are actually met. The mere fact that a product is ordered specifically for a customer does not automatically exclude the statutory right of withdrawal.

Where the statutory exception applies, the customer does not have a statutory 14-day withdrawal right for that product.

3. Important Distinction: Withdrawal vs. Warranty

The exclusion of the statutory withdrawal right for a custom-made product does not exclude or restrict statutory warranty rights.

If a product has a defect or does not conform to the agreed specifications, consumers retain all mandatory statutory rights under applicable Austrian consumer protection and warranty law.

A customer therefore cannot be refused a legitimate warranty claim merely because the product is custom-made.

4. Defective, Damaged or Incorrect Products

Please inspect your order promptly after delivery.

If you believe that your product:

• is defective,

• was damaged during delivery,

• does not correspond to the agreed specifications, or

• is not the product ordered,

please contact us as soon as reasonably possible at:

Please provide:

• your order number,

• a description of the issue,

• photographs or videos where appropriate, and

• any other information reasonably necessary for us to assess the issue.

This does not limit any statutory warranty rights or statutory deadlines.

5. Warranty Claims and Remedy

Where a statutory warranty claim exists, Benny Performance will provide the remedy required by applicable law.

Depending on the circumstances, this may include:

• repair/improvement,

• replacement,

• price reduction, or

• cancellation/resolution of the contract where the legal requirements for such a remedy are met.

Where repair or replacement is legally appropriate, we will arrange the remedy within a reasonable period and without charging the consumer costs that are legally required to be borne by the seller.

For products that require installation or removal, the scope of any legally required installation/removal costs will be determined in accordance with applicable law.

A customer cannot demand a refund solely because a repair or replacement is inconvenient where the legally applicable requirements for a different remedy have not been met.

6. Returns for Change of Mind

Where a statutory right of withdrawal applies, the consumer may withdraw from the contract within the applicable 14-day period without giving a reason.

Where no statutory right of withdrawal applies, for example because the product falls within a statutory exception for custom-made goods, Benny Performance does not provide an additional voluntary return right unless expressly agreed otherwise in writing.

A change of mind, inconvenience, longer-than-expected processing time, or reluctance to install a product does not by itself create a statutory warranty claim or a right to cancel a contract.

7. Condition of Goods Returned Under a Statutory Withdrawal Right

Where a statutory withdrawal right applies, the consumer must return the goods without undue delay and no later than 14 days after communicating the withdrawal.

The consumer may be liable for any loss in value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods, to the extent permitted by applicable law.

For vehicle components, customers should avoid installation, modification, disassembly or use beyond what is legally permitted when exercising a statutory withdrawal right.

If you wish to exercise a statutory withdrawal right or make a warranty claim, please contact us before sending the goods back.

Please include your order number and the reason for the return where applicable.

Goods sent back without prior contact may be delayed because we may not be able to identify the order or determine the reason for the return.

This does not affect any mandatory statutory rights.

9. Return Shipping Costs

Where a consumer validly exercises a statutory right of withdrawal, the consumer is generally responsible for the direct costs of returning the goods, unless Benny Performance has agreed to bear those costs or the applicable law provides otherwise.

Where a return is required because of a legally established defect or another statutory warranty claim, Benny Performance will bear the costs that the law requires the seller to bear.

10. Refunds Following a Valid Withdrawal

Where a statutory withdrawal is validly exercised, Benny Performance will refund the payments received from the consumer in accordance with applicable law.

Refunds will generally be made using the same payment method used for the original transaction, unless another method has been expressly agreed and does not cause additional costs to the consumer.

Where permitted by law, reimbursement may be withheld until the goods have been returned or the consumer has provided evidence that the goods have been sent back.

11. Custom Orders and Individual Specifications

Because some Benny Performance products are individually manufactured or modified, customers may be asked to confirm their specifications before production begins.

Customers are responsible for checking the selected specifications, vehicle compatibility and other information provided to us before production where the information is supplied by the customer.

Once an individually customized product has entered production, cancellation may not be possible where the applicable statutory right of withdrawal does not apply.

This does not affect any statutory rights arising from defects, non-conformity or failure to comply with the agreed specifications.

12. Exchanges

We do not provide a general voluntary exchange right for custom-made products unless expressly agreed otherwise.

Where a product is defective and applicable warranty law requires replacement, the replacement will be handled in accordance with the applicable statutory provisions.

A customer does not automatically have a right to exchange a correctly manufactured custom product for another configuration merely because the customer has changed their mind or no longer wants the selected configuration.

13. Products Damaged During Delivery

If your package appears visibly damaged upon delivery, please document the damage with photographs before opening the package where reasonably possible.

If the product itself is damaged, contact us promptly with photographs of:

• the outer packaging,

• the shipping label,

• the internal packaging, and

• the damaged product.

We will assess the matter and provide the remedy required under the applicable law.

14. Sale Items

Sale prices do not remove or restrict mandatory statutory consumer rights.

Where a statutory right of withdrawal applies, sale items remain subject to that statutory right unless a lawful exception applies.

15. Gift Cards

Gift cards are non-refundable unless otherwise required by applicable law.

Legal Notice

This policy is intended to describe the return, withdrawal and warranty procedures of Benny Performance in accordance with applicable Austrian and European consumer protection law.

Mandatory statutory consumer rights always prevail over this policy.
